ENGLISH

1. Scope
This agreement applies to ExactMouse Redux version 3.8.0 and later, including
updates, the documentation and all related files ("the Software"). By installing
or using the Software you accept this agreement. If you do not accept it, do not
install or use the Software.

2. Licence
The author grants you a non-exclusive, non-transferable, revocable licence to
install and use the Software on Macs that you own or control, for personal or
business use.
- The free features may be used free of charge.
- Pro features may require a paid licence key. During "Early Access" they are
  unlocked for everyone free of charge; this can end with a later version.
- A Pro licence is personal. It may only be used by the person or organisation
  that bought it, on the number of Macs stated at purchase.

3. Restrictions
Unless mandatory law expressly allows it, you may not:
- copy, distribute, publish, sell, rent, lend or sublicense the Software, or
  offer it for download, other than linking to the official download page;
- modify, translate, decompile, disassemble or otherwise reverse engineer the
  Software, or create derivative works from it (the rights under mandatory law,
  e.g. Sections 69d and 69e of the German Copyright Act, remain unaffected);
- bypass, disable or tamper with licence checks or Pro restrictions;
- remove or change copyright, trademark or legal notices.

4. Ownership
The Software is licensed, not sold. All rights, in particular copyright, in the
Software, its code, design, texts and icons remain with the author.

5. Earlier versions
Versions up to and including 3.7.5 were published under the MIT License. For
copies of those versions obtained at that time, the MIT License continues to
apply. It does not apply to version 3.8.0 or later.

6. Updates and data
The Software checks GitHub for new versions and can download them when you
install an update. It collects or sends no personal data. See LEGAL.md.

7. Warranty
The free Software is provided "as is". For paid licences the statutory warranty
rights apply. The author does not guarantee that the Software works without
errors or interruption, or with every device, macOS version or other software.

8. Liability
The author is liable without limitation for intent and gross negligence, for
injury to life, body or health, and under the German Product Liability Act. For
slight negligence the author is liable only for breach of an essential
contractual obligation (an obligation whose fulfilment makes the proper
performance of the contract possible in the first place and on which you may
regularly rely), and limited to the damage that is typical and foreseeable for
this kind of contract. For software provided free of charge the author is liable
only for intent and gross negligence. Any further liability is excluded.

9. Termination
This licence ends automatically if you breach it. You must then delete all
copies of the Software.

10. Trademarks
"SteelSeries" and "ExactMouse" are trademarks of SteelSeries ApS. ExactMouse
Redux is not a SteelSeries product and is not affiliated with SteelSeries ApS.

11. Final provisions
German law applies, excluding the UN Convention on Contracts for the
International Sale of Goods (CISG). If you are a consumer, this choice of law does
not deprive you of the protection of the mandatory provisions of the law of the
country where you habitually reside. If a provision is invalid, the remaining
provisions stay in effect.

1. Geltungsbereich
Dieser Vertrag gilt für ExactMouse Redux ab Version 3.8.0, einschließlich
Updates, Dokumentation und zugehöriger Dateien („die Software"). Mit der
Installation oder Nutzung der Software stimmst du diesem Vertrag zu. Stimmst du
nicht zu, installiere und nutze die Software nicht.

2. Lizenz
Der Autor räumt dir ein einfaches, nicht übertragbares, widerrufliches Recht
ein, die Software auf Macs zu installieren und zu nutzen, die dir gehören oder
die du verwaltest, privat oder beruflich.
- Die kostenlosen Funktionen dürfen unentgeltlich genutzt werden.
- Pro-Funktionen können einen kostenpflichtigen Lizenzschlüssel erfordern. Im
  „Early Access" sind sie für alle kostenlos freigeschaltet; das kann mit einer
  späteren Version enden.
- Eine Pro-Lizenz ist persönlich. Sie darf nur von der Person oder Organisation
  genutzt werden, die sie gekauft hat, auf der beim Kauf genannten Zahl von Macs.

3. Einschränkungen
Soweit zwingendes Recht es nicht ausdrücklich erlaubt, darfst du nicht:
- die Software kopieren, verbreiten, veröffentlichen, verkaufen, vermieten,
  verleihen, unterlizenzieren oder zum Download anbieten, außer durch einen
  Link auf die offizielle Download-Seite;
- die Software verändern, übersetzen, dekompilieren, disassemblieren oder
  anderweitig zurückentwickeln oder abgeleitete Werke daraus erstellen (die
  zwingenden Rechte, z. B. nach §§ 69d und 69e UrhG, bleiben unberührt);
- Lizenzprüfungen oder Pro-Beschränkungen umgehen, abschalten oder verändern;
- Urheber-, Marken- oder Rechtshinweise entfernen oder ändern.

4. Rechte
Die Software wird lizenziert, nicht verkauft. Alle Rechte, insbesondere das
Urheberrecht, an der Software, ihrem Code, Design, Texten und Symbolen
verbleiben beim Autor.

5. Frühere Versionen
Versionen bis einschließlich 3.7.5 wurden unter der MIT-Lizenz veröffentlicht.
Für damals bezogene Kopien dieser Versionen gilt die MIT-Lizenz weiter. Für
Version 3.8.0 und neuer gilt sie nicht.

6. Updates und Daten
Die Software fragt bei GitHub nach neuen Versionen und lädt sie, wenn du ein
Update installierst. Sie erhebt und sendet keine personenbezogenen Daten.

7. Gewährleistung
Die kostenlose Software wird so bereitgestellt, wie sie ist. Für
kostenpflichtige Lizenzen gelten die gesetzlichen Gewährleistungsrechte. Der
Autor sichert nicht zu, dass die Software fehlerfrei, ununterbrochen oder mit
jedem Gerät, jeder macOS-Version oder anderer Software funktioniert.

8. Haftung
Der Autor haftet unbeschränkt bei Vorsatz und grober Fahrlässigkeit, bei
Verletzung von Leben, Körper oder Gesundheit sowie nach dem
Produkthaftungsgesetz. Bei leichter Fahrlässigkeit haftet der Autor nur bei
Verletzung einer wesentlichen Vertragspflicht (einer Pflicht, deren Erfüllung
die ordnungsgemäße Durchführung des Vertrags überhaupt erst ermöglicht und auf
deren Einhaltung du regelmäßig vertrauen darfst), begrenzt auf den
vertragstypischen, vorhersehbaren Schaden. Für unentgeltlich überlassene
Software haftet der Autor nur bei Vorsatz und grober Fahrlässigkeit. Eine
weitergehende Haftung ist ausgeschlossen.

9. Beendigung
Diese Lizenz endet automatisch, wenn du gegen sie verstößt. Du musst dann alle
Kopien der Software löschen.

10. Marken
„SteelSeries" und „ExactMouse" sind Marken der SteelSeries ApS. ExactMouse
Redux ist kein Produkt von SteelSeries und nicht mit der SteelSeries ApS
verbunden. Siehe LEGAL.md.

11. Schlussbestimmungen
Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts (CISG). Bist du
Verbraucher, wird dir dadurch nicht der Schutz der zwingenden Bestimmungen des
Rechts des Staates entzogen, in dem du deinen gewöhnlichen Aufenthalt hast.
Ist eine Bestimmung unwirksam, bleiben die übrigen wirksam.
